Alina Habba has resigned as New Jersey's top federal prosecutor. This comes after a legal ruling that questioned her eligibility to serve.

Attorney General's Statement

The head of the Justice Department, Pam Bondi, announced the prosecutor's departure on the start of the week. In a statement that the judicial decision made it "untenable" for her to perform her duties.

"But do not mistake compliance for surrender," she declared. "The effort will now stretch across the country."

Judicial Challenge

The departure follows closely on a judicial panel ruled that she had been acting without proper authority as US attorney. This decision is likely to affect numerous legal proceedings in the state.

The appellate judges said that a acting appointment that skirted confirmation by the US Senate violated the federal law governing appointments.

The Attorney General added that the former prosecutor will stay on at the DOJ as a high-level advisor. Habba plans to pursue additional appeals of the disqualification, in the hope of achieving a overturned decision.

Writing online, Bondi argued that the court "must not countermand the executive's selection of lawyers tasked with performing the fundamental role of the presidency of enforcing the law."
